1. Agreement to Terms

Welcome to ActionFun Land. By accessing our amusement park facilities, purchasing tickets, or using our website and services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and ActionFun Land Pty Ltd, located at 73 King William St, Adelaide SA 5000, Australia. If you do not agree with any part of these terms, you must not use our services or enter our premises.

We reserve the right to modify these terms at any time without prior notice. Your continued use of our services after changes have been made constitutes your acceptance of the new terms. It is your responsibility to review these terms periodically for updates and changes.

2. Park Entry and Admission

2.1 Ticket Purchase and Validity

All tickets must be purchased through our official website, authorized ticket vendors, or at our park entrance. Tickets are non-refundable and non-transferable unless otherwise stated in our refund policy. Each ticket is valid only for the date specified at the time of purchase and cannot be used on any other day without prior authorization from park management.

2.2 Age Requirements

Children under the age of 12 must be accompanied by a responsible adult (18 years or older) at all times while in the park. Proof of age may be required for certain attractions and services. We reserve the right to deny entry to any person who cannot provide adequate identification when requested.

2.3 Right of Admission

ActionFun Land reserves the right to refuse admission or remove any person from the park premises for any reason, including but not limited to:

• Intoxication or being under the influence of drugs or alcohol
• Disorderly, disruptive, or threatening behavior
• Failure to comply with park rules and staff instructions
• Possession of prohibited items
• Violation of safety regulations

3. Safety Rules and Regulations

3.1 Ride Safety Requirements

All guests must comply with height, age, weight, and health restrictions posted at each attraction. These restrictions are in place for your safety and are strictly enforced. Failure to meet these requirements will result in denial of access to that particular attraction. No exceptions will be made regardless of circumstances.

3.2 Health Conditions

Guests with pre-existing medical conditions including but not limited to heart conditions, high blood pressure, back or neck problems, pregnancy, or recent surgery should consult with their physician before visiting the park. Certain attractions may pose risks to individuals with these conditions. ActionFun Land assumes no responsibility for health complications arising from participation in park activities.

3.3 Prohibited Items

The following items are strictly prohibited from being brought into the park:

• Weapons of any kind including knives, guns, and explosives
• Illegal drugs and controlled substances
• Alcohol and alcoholic beverages
• Glass containers
• Professional photography equipment without prior authorization
• Drones or remote-controlled flying devices
• Pets (except registered service animals)

4. Visitor Conduct and Behavior

All visitors are expected to conduct themselves in a respectful and appropriate manner at all times. Disruptive behavior, profanity, harassment of staff or other guests, vandalism, or any form of misconduct will result in immediate removal from the park without refund. Criminal behavior will be reported to local law enforcement authorities.

Guests must follow all posted signs, barriers, and instructions from park staff. Queue jumping, line cutting, and reservation of spaces in queues are prohibited. Smoking is only permitted in designated smoking areas clearly marked throughout the park. Littering is strictly prohibited and may result in fines.

5. Liability and Assumption of Risk

5.1 Assumption of Risk

By entering ActionFun Land, you acknowledge that amusement park activities involve inherent risks including but not limited to the risk of physical or emotional injury, illness, or property damage. You voluntarily assume all risks associated with park activities and agree to hold ActionFun Land harmless for any injuries or damages that may occur.

5.2 Limitation of Liability

To the maximum extent permitted by law, ActionFun Land, its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of park facilities or services. Our total liability for any claim shall not exceed the amount paid for your admission ticket.

5.3 Personal Property

ActionFun Land is not responsible for lost, stolen, or damaged personal property. Guests are advised to secure their belongings in provided lockers or leave valuables at home. Items lost or left behind in the park will be held in our lost and found for 30 days before being disposed of or donated.

6. Photography and Image Rights

By entering the park, you grant ActionFun Land the irrevocable right to photograph, film, or record your image and likeness for promotional, marketing, and operational purposes. These images may be used in print materials, website content, social media, television advertisements, and other media without compensation or notification to you.

Professional photography and videography for commercial purposes require advance written permission from park management. Personal photography is permitted but must not interfere with park operations or other guests' enjoyment. Use of flash photography on rides is prohibited for safety reasons.

7. Website Use and Online Services

7.1 Account Registration

When creating an account on our website, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.

7.2 Intellectual Property

All content on the ActionFun Land website including text, graphics, logos, images, videos, and software is the property of ActionFun Land or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content without express written permission.

7.3 Privacy and Data Protection

8. Refunds and Cancellations

All ticket sales are final and non-refundable except in the following circumstances: park closure due to severe weather, emergency situations, or technical failures affecting the majority of attractions. In such cases, guests may be offered rain checks, rescheduling options, or partial refunds at management's discretion.

Special event tickets, annual passes, and promotional tickets are subject to additional terms and conditions specified at the time of purchase. Requests for refunds due to personal circumstances, change of plans, or minor attraction closures will not be honored.

9. Force Majeure

ActionFun Land shall not be liable for any failure or delay in performance of its obligations due to circumstances beyond its reasonable control including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government regulations, labor disputes, or utility failures. In such events, our obligations will be suspended for the duration of the force majeure event.

10. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of South Australia, Australia, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of park facilities shall be resolved exclusively in the courts of South Australia.

Before initiating any legal proceedings, parties agree to attempt to resolve disputes through good faith negotiations. If negotiations fail, either party may pursue binding arbitration or court proceedings as appropriate under Australian law.

11. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
